1. Agreement to Terms

Welcome to Wet Tail ("we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of www.wet-tail.com (the "Site") and your purchase of any products offered through the Site.

By accessing the Site or placing an order, you agree to be bound by these Terms, our Privacy Policy, Shipping Policy, and Return & Refund Policy. If you do not agree, please do not use the Site.

We reserve the right to update these Terms at any time. Changes take effect upon posting. Your continued use of the Site constitutes acceptance of the revised Terms.

3. Eligibility

You must be at least 18 years of age or the age of majority in your jurisdiction to use the Site and make purchases. By using the Site, you represent and warrant that you meet these requirements.

4. Products

All products displayed on the Site are subject to availability. We make every effort to display product colours and details as accurately as possible. However, we cannot guarantee that your device's display will accurately reflect the actual colour or detail of the products.

We reserve the right to limit the quantity of any product, to discontinue any product at any time, and to refuse service to anyone at our discretion.

Product descriptions, including fabric composition, care instructions and sizing, are provided for informational purposes. Minor variations in colour, texture or sizing may occur between production runs due to the nature of garment manufacturing.

5. Pricing and Payment

All prices displayed on the Site are in Euros (€). Prices include shipping to all supported destinations. All orders are shipped DDP (Delivered Duty Paid), meaning customs duties, import fees and all applicable taxes are included. You will not be charged any additional fees upon delivery.

We accept payment methods as displayed at checkout. All payments are processed securely through our third-party payment provider. We do not store your credit card or payment details.

We reserve the right to change prices at any time without prior notice. The price applicable to your order is the price displayed at the time of purchase.

In the unlikely event a product is listed at an incorrect price due to a technical error, we reserve the right to cancel the order and notify you. If payment has been taken, a full refund will be issued.

6. Orders and Contract Formation

When you place an order through the Site, you are making an offer to purchase the selected products. Your order is subject to acceptance by us.

You will receive an order confirmation email upon placing your order. This confirmation acknowledges receipt but does not constitute acceptance. A binding contract is formed only when your order has been dispatched and you receive a shipping confirmation email.

We reserve the right to refuse or cancel any order at our discretion, including but not limited to cases of suspected fraud, pricing errors, product unavailability or incomplete order information.

7. Shipping and Delivery

Full details of our shipping practices are set out in our Shipping Policy. Key points:

  • We ship to the European Union (including Italy), the United States and Canada.
  • All orders include free standard shipping.
  • All orders are shipped DDP (Delivered Duty Paid). No additional fees will be charged upon delivery.
  • Orders are processed within 1–2 business days. Estimated delivery is 8–12 business days.
  • We are not responsible for delays caused by customs processing, incorrect addresses, carrier disruptions, weather or circumstances beyond our control.

8. Returns and Refunds

Full details are set out in our Return & Refund Policy. Key points:

  • EU customers have a 14-day right of withdrawal under Directive 2011/83/EU.
  • US and Canadian customers may return items within 14 days of delivery.
  • Items must be unworn, unwashed, unaltered, with all tags attached.
  • Return shipping is the customer's responsibility.
  • We recommend SF Express International for returns.

9. Intellectual Property

All content on the Site, including text, images, graphics, logos, product designs, photography and brand elements, is the exclusive property of Wet Tail Clothing Studio Limited or its licensors and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display or exploit any content from the Site without our prior written consent.

10. User Accounts

When you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You agree to provide accurate and complete information and to update it as needed.

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

11. Prohibited Conduct

You agree not to: use the Site for any unlawful purpose; attempt to gain unauthorised access to any part of the Site; interfere with or disrupt the Site's operation; submit false or misleading information; use automated systems to scrape or extract data from the Site; resell products purchased from the Site without our written consent.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Wet Tail Clothing Studio Limited shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from or related to your use of the Site or purchase of products.

Our total liability for any claim shall not exceed the total amount you paid for the specific order giving rise to the claim.

Nothing in these Terms shall exclude or limit our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by applicable law.

13. Indemnification

You agree to indemnify and hold harmless Wet Tail Clothing Studio Limited, its directors, officers, employees and agents from any claims, damages, losses or expenses arising from your breach of these Terms or your violation of any law or the rights of a third party.

14. Governing Law and Disputes

These Terms are governed by the laws of the Hong Kong Special Administrative Region.

For EU consumers: nothing in these Terms affects your statutory rights under mandatory consumer protection laws of your country of residence. You may bring claims before the competent courts of your country of residence in accordance with applicable consumer law. EU consumers may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

For US and Canadian consumers: disputes shall be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to the courts of Hong Kong SAR.

15. Force Majeure

We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including natural disasters, pandemics, war, government actions, embargoes, carrier disruptions, labour disputes or disruptions to utility or telecommunications services.

16. Severability

If any provision of these Terms is found invalid, illegal or unenforceable, the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, Shipping Policy, and Return & Refund Policy, constitute the entire agreement between you and Wet Tail Clothing Studio Limited regarding your use of the Site and purchase of products.
